Residential Possession
Each Section 8 ground for possession has a different notice period. Upon the expiry of the notice period, court proceedings may be issued. A hearing date is likely to be listed within 1-2 months of issue in the local County Courts, although this is likely to be longer in the London Courts. If it is necessary to apply for a bailiff’s warrant, following the application, it usually takes up to 2 months for a bailiff’s appointment to be arranged in the local County Courts although it can be longer.
Commercial Possession/Lease Renewal
The timeframe for possession and lease renewal proceedings in relation to commercial property depends on the circumstances. There are many potential scenarios and costs assessment can rarely be precise.
For example, if the tenant(s) is in arrears of rent which has been outstanding in breach of the lease, there may be a forfeiture clause within the lease which permits forfeiture, in this case, you may be able to forfeit the lease immediately. In some circumstances Court proceedings are required and the progress of this claim is highly dependant upon the approach of the (other side). Lease renewal may be broadly consensual or highly contested
